ADULT CHILDREN AND THE 1975 INHERITANCE ACT

 

Ilott v Mitson & ors [2011] EWCA Civ 346 will greatly assist in advising adult children on their prospects of making a successful application under The Inheritance (Provision for Family and Dependants) Act 1975. The Court of Appeal has emphatically clarified the correct approach for the court to take to such a claim – and it is good news for needy adult children.

JONES v KERNOTT PRACTICE POINTS

For Chancery and family practitioners dealing with cohabitation claims the wait is over: the Supreme Court finally handed down its Judgment in the eagerly awaited case of Jones v Kernott on 9th November 2011.  The latest in a long line of judicial efforts to grapple with the problems created by co-ownership of property, the main impact of the judgment will be in 'joint names' cases.
