Amy Stout appears in Court of Appeal

Amy Stout represented the Respondent Father in the case of Re EY [2023] EWCA Civ 1241

The Court of Appeal allowed an appeal brought by the Local Authority where the first instance Judge refused to make the findings sought by the local authority and find that threshold is not crossed. The Court of Appeal provide helpful guidance on how to approach the reports of experts where a report is challenged but the expert is not called at final hearing. The Court of Appeal emphasised the quasi-inquisitive nature of family law and the need for the Judge to scrutinise the questions asked of experts and of the findings sought by the Local Authority.
