Private FDR
3DJB are pleased to offer a range of practitioners suitable to undertake private FDRs as an alternative to the stress, delay and uncertainty of litigation and court proceedings.
The Financial Dispute Resolution (FDR) hearing is an important stage of financial proceedings designed to help parties reach a final settlement by agreement and to avoid the costs and uncertainty of a final hearing. At this hearing, the Judge hears a summary from each party and provides an indication of what would be the likely outcome if the matter goes to final hearing and encourages the parties to negotiate in light of this. As with all court proceedings, it can take a significant period of time for this to be listed and court Judges will have a number of other matters to deal with at the same time. This can result in delay and increased costs.
Parties can choose to “opt out” of the court’s FDR and agree a suitably qualified lawyer to conduct a private FDR once full disclosure has been given. At 3DJB a well-prepared and expert barrister then sits as the Judge hearing from the parties and providing an indication of the outcome and the reasons why. Our barrister will then be on hand to help the parties resolve the case through negotiations. This gives the parties the opportunity to choose their own tribunal, at a time convenient to them and can save costs.
3DJB can conduct private FDRs remotely or within Chambers. Our private FDR practitioners are all experienced barristers in matrimonial finance who provide an expert service to help clients achieve full and final settlement without delay.
