Luke Barnes - Bruton v Bruton

Luke Barnes acted in the matter of Bruton v Bruton K00RM318 (decided in the County Court at Romford by DDJ Perry) the right of survivorship applied to over £120,000 held in a joint bank account in the names of the deceased father James Bruton and the Defendant Peter Bruton. Drakeford v Cotton  [2012] 3 All ER 1138 applied and the Claimant Robert Bruton failed to rebut the presumption of advancement so that Peter was solely entitled to the balance – although James was the source of all the money and had left his estate to his sons in equal shares. Robert Bruton’s claim for occupation rent and a sale on the open market were also dismissed – the property was to be sold to Peter Bruton at a price determined by the court (as approved in Bagum v Hafiz [2016] Ch 241, CA).
