Surrey County Council v Mother & Ors [2025] EWFC 507 (B) (10 June 2025)
Haroon Rana, led by Sam Momtaz KC, acted for the respondent father in the matter of Surrey County Council v Mother & Ors [2025] EWFC 507 (B) (10 June 2025). The judgment, although handed down last year, was published recently and is available to read here.
This was a combined fact finding and final hearing in public law proceedings. The case concerned allegations against the parents of non-accidental injuries, including haemorrhages/fractures, to their two-week-old baby. The court heard evidence from several experts, including a Consultant Paediatric Neurosurgeon, Consultant Paediatric Neuro Radiologist, Consultant Paediatrician, Consultant Haematologist and Consultant Geneticist. In the court’s judgment, it was determined the local authority failed to prove that the injuries were non-accidental in nature.
